1) Who We Are

2) Eligibility & Accounts

  1. Eligibility. The Site is intended for individuals who are at least 13 years old. If you are under the age of majority where you live, you may only use the Site with a parent/guardian’s consent.
  2. EU/EEA/UK Users. If you are located in the EU/EEA/UK, you may use the Site; however, certain features may be unavailable unless permitted by applicable law and our Privacy Policy. We will process personal data as described in our Privacy Policy.
  3. Account Registration. You must provide accurate, current information and keep it updated. You are responsible for maintaining the security of your account and password and for all activity under your account.
  4. Notice of Unauthorized Use. Notify us immediately of any unauthorized use or security breach. We are not liable for any loss arising from unauthorized use of your account.

3) Store Terms (Orders, Pricing, Shipping & Returns)

  1. Products. We sell tea products only. Ingredients, allergens, and nutrition (where applicable) will be listed on product pages. We strive for accuracy, but errors may occur; we may correct errors and update information without notice, including after you submit an order.
  2. Order Acceptance. Your order is an offer to buy. We may accept, reject, or limit any order for any lawful reason (e.g., suspected fraud, reseller activity, inventory constraints). We will issue a refund if we cancel after charging you.
  3. Pricing & Currencies. Prices may be displayed in USD, EUR, CAD, or GBP. The currency used to charge your order will be shown at checkout. Applicable taxes, duties, and shipping fees are extra.
  4. International Orders. For cross-border shipments, you are the importer of record and responsible for customs clearance, duties, and compliance with local laws.
  5. Payment. We accept the payment methods shown at checkout and may use third-party processors. By submitting a payment method, you represent you are authorized to use it and authorize us (and our payment processor) to charge the total order amount, including shipping and taxes.
  6. Shipping & Risk of Loss. Title and risk of loss pass to you upon our delivery to the carrier. Delivery timelines are estimates and not guarantees. Once marked delivered by the carrier, claims for loss/theft should be made with the carrier; we may assist at our discretion.
  7. Returns & Refunds. Our policy will be available at /returns. We may require proof of purchase and may refuse returns that violate policy or health/safety standards (e.g., opened consumables unless defective).
  8. Resale & Quantity Limits. Purchases are for end-consumer use only. We may limit, cancel, or refuse orders that appear to be placed by dealers, resellers, or distributors.
  9. Promotional Errors. We are not obligated to honor obvious errors, misprints, or inaccuracies in price or promotion.

4) Subscriptions & Auto-Renewals

We do not currently offer subscription or auto-renew programs.

5) Fair Trade & Sustainability

Tsara Tea is committed to ethical sourcing and responsible production. Where applicable, we strive to work with suppliers and growers that follow fair labor practices and environmentally responsible agriculture. We may describe our sustainability initiatives on the Site (e.g., fair trade programs, compostable/low-impact packaging, water stewardship, or community support). Certifications or claims will be stated on the relevant product pages. Sustainability initiatives do not modify these Terms unless explicitly stated in a written policy.

6) Promotions, Gift Cards & Credits

  1. Codes & Offers. Promo codes are single-use, non-transferable, and subject to published terms. They may not be combined or redeemed for cash and may expire.
  2. Gift Cards. Unless required by law, gift cards are non-refundable, not reloadable, and not redeemable for cash. Treat them like cash; lost or stolen cards will not be replaced.
  3. Store Credit. Store credit may be issued for returns or customer service reasons and is subject to expiration or limitations as disclosed when issued.

7) Your Reviews & Submissions

  1. Acceptable Content. You may submit product reviews, photos, questions, and suggestions that are accurate and lawful and do not include spam, harassment, hate speech, illegal content, or others’ confidential information.
  2. License. By submitting content, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your content in any media.
  3. Moderation. We may monitor, edit, refuse, or remove content at our discretion, but we do not assume any obligation to do so.
  4. Representations. You represent you own your content or have the necessary rights and that your content does not violate any law or third-party rights.

8) Acceptable Use

You agree not to (and not to permit or assist others to):

  • Use the Site for any unlawful purpose or to violate any law or regulation;
  • Attempt to interfere with the integrity or security of the Site, including probing, scanning, scraping, or overloading;
  • Use any robot, spider, or other automated means without our prior written consent;
  • Reverse engineer or attempt to derive source code from any portion of the Site except to the limited extent permitted by law;
  • Misrepresent your identity or affiliation or engage in fraudulent or misleading conduct;
  • Use the Site to develop competing products or services or for any commercial use not expressly permitted.

9) Intellectual Property & License

  1. Ownership. The Site, including all content, text, images, logos, trademarks, service marks, product names, videos, audio, graphics, code, and design (collectively, “Tsara Content”) is owned by us or our licensors and protected by copyright, trademark, and other laws.
  2. Limited License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for personal, non-commercial purposes. All rights not expressly granted are reserved.
  3. Notice of Infringement. If you believe content on the Site infringes your copyright or trademark, email Support@tsaratea.com with: (i) identification of the work, (ii) identification of the allegedly infringing material and its location, (iii) your contact info, (iv) a statement of good-faith belief, and (v) a statement under penalty of perjury that you are authorized to act. We may remove or disable content in our discretion.

10) Third-Party Services & Links

The Site may integrate or link to third-party platforms (e.g., payment processors, shipping providers, loyalty apps, social media). We are not responsible for third-party terms or privacy practices. Your use of third-party services is at your own risk and may be governed by their terms and policies.

11) Electronic Communications; SMS/Email Consent

By using the Site, you consent to receive communications from us electronically (e.g., emails, notices on the Site). If you opt in to SMS or marketing emails, you consent to receive marketing messages at the phone number/email provided. Message and data rates may apply. You may opt out at any time via provided methods (e.g., reply STOP for SMS, unsubscribe for email). Our Privacy Policy will explain how we handle your data.

12) Disclaimer of Warranties

YOUR USE OF THE SITE AND TSARA CONTENT IS AT YOUR SOLE RISK. THE SITE AND TSARA CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PROCUREMENT OF SUBSTITUTE GOODS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR TSARA CONTENT, HOWEVER CAUSED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Certain jurisdictions do not allow limitations on implied warranties or the exclusion/limitation of certain damages; some of the above may not apply to you, and you may have additional rights.

14) Indemnification

You agree to defend, indemnify, and hold harmless Tsara and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your content, or your violation of these Terms or any law.

15) Governing Law & Dispute Resolution

  1. Law & Venue. These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the courts located in Vancouver, British Columbia.
  2. Class Action Waiver. To the extent permitted by law, disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16) Changes to the Site or Terms

We may modify or discontinue the Site (in whole or part) and may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and, where required by law, additional notice. Your continued use after changes become effective constitutes acceptance of the updated Terms.

17) Termination

We may suspend or terminate your account or access to the Site at any time for any reason, including if we reasonably believe you have violated these Terms. You remain responsible for orders placed or charges incurred before termination. Sections that by their nature should survive termination shall so survive.

18) General Terms

  • Entire Agreement. These Terms, along with any policies referenced (e.g., Privacy, Returns), constitute the entire agreement between you and us regarding the Site and supersede prior or contemporaneous agreements on the subject matter.
  • Severability. If any provision is found invalid or unenforceable, the remainder shall continue in full force and effect.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign or transfer your rights or obligations without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
  • Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.
  • Export & Sanctions. You agree to comply with applicable export control and economic sanctions laws.
